Deadly Birth Injuries Caused by Oregon Medical Malpractice

Oregon Medical Malpractice Causing Fatal Birth Injuries: Wrongful Death of a Newborn

Our children are our most cherished thing in life.  While giving birth is a very stressful time, it is also a very exciting time for a family—especially a new family—and it is supposed to be one of the happiest, most joyous times.  Unfortunately, that is not always the case when Oregon medical malpractice results in catastrophic injury to a newborn which become fatal.  The wrongful death of our child is one of the saddest times in our life.  This is especially true when medical errors, carelessness, recklessness, or negligence causes the wrongful death.

Newborns are suspecting to serious injury during the labor and delivery process.  This is easily understood as newborns are some of, if not the most, vulnerable population.  They are completely dependent on the medical team to safely be brought into this world.  Some common types of birth injuries which could result in fatal injuries include many of the following:

Delivery Trauma Caused by Excessive Use of Extraction Tools – When a newborn is either in a bad position, stuck, or needs to be pulled out, certain extraction tools are helpful.  One of the most commonly thought of is the forceps, which are tong-like tools used to grab and pull the baby.  But more commonly is a vacuum extractor, which is a tool that uses suction to pull a baby out.  However, both of these tools can cause serious trauma on a baby because they are stronger than the baby’s skin, muscle, and tissue.  Forceps can easily cause serious lacerations and injuries, including to nerves or vital vessels.  Vacuum extractors can also cause serious damage to tissue and even deform the head and brain.  Too much use could cause brain injuries to a baby.  Serious overuse and cause fatal injuries which result in the wrongful death of the baby.

Failing to Monitor the Baby – The labor and delivery clinic at a hospital should be constantly monitoring for fetal distress.  Fetal distress is an indicator that something is very wrong, usually with oxygen.  The lack of oxygen for a newborn is going to cause serious injury to the brain and organs.  Prolonged hypoxic (lack of oxygen) conditions will result in significant brain damage or wrongful death.

Fatal Infections Caused by the Hospital – Hospital acquired infections are some of the most dangerous and deadly.  One common type is MRSA, which is known as a “superbug” and is resistant to many forms of antibiotics.  These infections can be acquired by a newborn during the labor and delivery process or after birth in observation or the NICU (neonatal intensive care unit).  A drug-resistant infection to a newborn is most likely to be fatal.

Medication Overdoses to a Baby – If the newborn is in need of medication or antibiotics after birth, such as to combat a serious condition caused by the birth or an infection during the birthing process, a medication overdose can easily be fatal to a baby.  A newborn’s body is rapidly adjusting to its new world, and all systems are fully independent from the mother for the first time.  A medication overdose can and will cause severe damage to these already stained systems, and it will likely be fatal to these strained and already fragile organs.
